Lahore (Showbiz Desk) Renowned Pakistani singer Rahat Fateh Ali Khan has received significant legal relief in a case related to an inheritance property dispute.
The Lahore High Court has set aside the trial court’s decision that dismissed his appeal due to non-payment of court fees and has restored the appeal.
Justice Muhammad Sajid Mahmood Sethi issued an eight-page detailed judgment on the petition, directing the petitioner to deposit a fine of one hundred thousand rupees.
According to the court's decision, Rahat Fateh Ali Khan had approached a civil court seeking confirmation of his possession of a double-storey house measuring one kanal and nine marlas in Faisalabad. The civil court ruled against him on May 14, 2019, after which he filed an appeal before the trial court.
The judgment stated that the trial court had dismissed the appeal on technical grounds due to the non-payment of a court fee amounting to fifteen thousand rupees. Following this decision, he approached the High Court.
The court observed that dismissing an appeal solely on the basis of non-payment of court fees or other technical deficiencies is not consistent with the principles of justice. The judgment further emphasized that the right of appeal is an important legal right and should not be extinguished merely because of technical reasons.
