Islamabad (Pakistan News) The process of transferring judges of the Islamabad High Court to other provinces without their consent, under a constitutional amendment, has been initiated.
Chief Justice of Pakistan Yahya Afridi has summoned a meeting of the Judicial Commission on April 28 for the transfer of five judges of the Islamabad High Court. The meeting will be held at 1:00 PM in Islamabad, which he will chair as the head of the commission.
According to sources, the meeting will consider the names of five judges, including Justice Mohsin Akhtar Kayani, Justice Sardar Ejaz Ishaq, and Justice Babar Sattar, for transfer.
Under the plan, two judges are likely to be transferred to the Lahore High Court, while the remaining three may be posted to the high courts of Balochistan, Sindh, and Khyber Pakhtunkhwa.
Sources said informal consultations have been completed and the decision on transfers will be made on the basis of majority opinion.
It is worth mentioning that after changes in Article 200 of the Constitution under the 27th Constitutional Amendment, the requirement of a judge’s consent for transfer has been removed. Earlier, consent was mandatory.
Under the new amendment, consent is no longer required, and implementation will be carried out after the commission’s decision.
